1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Apice Tech Pvt. Ltd. ("Company," "we," "us," or "our"), concerning your access to and use of the aptbrandlab.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). We are registered in India and have our registered office at 107/4, Viswadeep Tower, District Center, Janak Puri, New Delhi, 110058.

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service from time to time.

The Site is intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside must have the permission of, and be directly supervised by, their parent or guardian to use the Site.

2. User Representations

4. Grant License

5. Mobile Application License

If you access the Site via a mobile application, we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the mobile application on wireless electronic devices owned or controlled by you. You shall not:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of, or decrypt the application;
  • Make any modification, adaptation, improvement, enhancement, translation, or derivative work from the application;
  • Violate any applicable laws, rules, or regulations in connection with your access or use of the application;
  • Remove, alter, or obscure any proprietary notice posted by us or the licensors of the application;
  • Use the application for any revenue generating endeavour or commercial enterprise for which it is not designed or intended;
  • Use the application to send automated queries to any website or to send any unsolicited commercial e-mail.

6. Fees

Some features of the Service may only be accessed and used upon the payment of applicable fees ("Fees"). Fees may vary depending on usage in accordance with our current pricing policy. All Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are solely responsible for payment of all such taxes, levies, or duties.

The Site may contain links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content belonging to or originating from third parties ("Third-Party Content"). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site.

(a) Confidential Information: Each party may disclose "Confidential Information" to the other party in connection with the Service. Confidential Information does not include information that is or becomes generally available to the public, was known to the Receiving Party prior to its disclosure, is received from a third party without breach of any obligation, or was independently developed by the Receiving Party.

(b) Protection and Use: The Receiving Party will take at least reasonable measures to prevent the unauthorized disclosure or use of Confidential Information, and not use or disclose any Confidential Information for any purpose outside the scope of the Service.

(c) Compelled Disclosure: The Receiving Party may access or disclose Confidential Information if required by law, provided that prior notice is given to the Disclosing Party to the extent legally permitted.

13. Location of the Service

The Company operates or controls the operation of the Service from Servers hosted on Amazon Web Services in the availability zone for India. The Company makes no representation or warranty that all features of the Service will be available outside of India.

14. Governing Law

These Terms shall be governed by and defined following the laws of India. Apice Tech Pvt. Ltd. and yourself irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

15. Dispute Resolution

Any dispute arising out of or in connection with this contract shall be referred to and finally resolved by Arbitration according to the Arbitration and Conciliation Act, 1993. The seat of arbitration shall be New Delhi, India. The language of the proceedings shall be English. The governing law of the contract shall be the substantive law of India.

16. Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

17. Disclaimer

The site is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties or representations about the accuracy or completeness of the site's content.

18. Limitations of Liability

Cancellation / Refund Policy

1. Cancellation

You can cancel your subscription at any time. The cancellation will take effect at the end of the period you have already paid for.

2. Refunds

All sales are final and no refund will be issued. We do offer refunds on a case to case basis at our sole discretion, if a request has been raised within 48 hours of the purchase or renewal date.

Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") applies to the use of any product, service or website provided by Apice Tech Pvt. Ltd. ("Company" "us"), whether we provide it directly or use another party to provide it to you. This AUP is designed to ensure compliance with the laws and regulations that apply to the Company and protects the interests of all of our clients and their customers.

Every user/client of ours agrees to abide by this AUP and is responsible for any violations. We may suspend or terminate your use of Services pursuant to our Customer Terms of Service for violations of this AUP.

2. Reporting Suspected Violations

We encourage recipients of email messages sent using the Service to report suspected violations of this AUP to us by forwarding a copy of the received email with full headers to aptbrandlab@gmail.com.

3. Prohibited Actions

You may not use the Services to:

  • Do anything in violation of the General Data Protection Regulation (GDPR);
  • Launch or facilitate a denial-of-service attack on the Services or on any third party;
  • Do phishing or engage in identity theft;

4. Proper Usage of the Service

  • Promotes, encourages, or facilitates hate speech, violence, or discrimination based on race, color, sexual orientation, gender or identity expression, religion, national origin or ancestry, age, disability, or any other characteristic protected by law.

5. Restricted Industries

We reserve the right to discontinue your use of the Services if you are in one of these industries:

  • Escort and dating services;
  • Gambling services or products;
  • Selling 'Likes' or followers for a social media platform;
  • Any other industry declared as illegal by the law of land.

6. Enforcement

Your services may be suspended or terminated with or without notice upon any violation of this policy. We are not obligated to, but may choose to, remove any prohibited materials and deny access to any person who violates this AUP.
